Right of Withdrawal and Returns

Article 1 – Legal framework and scope

The statutory right of withdrawal is governed by Articles L.221-18 to L.221-28 of the French Consumer Code and by Directive 2011/83/EU on consumer rights.
Subject to the statutory exceptions described below, a consumer purchasing goods remotely through jalaero.com may withdraw from the contract within 14 calendar days without providing a reason.
This right of withdrawal is separate from the statutory legal guarantee of conformity, any warranty supplied with a product and any claim concerning a defective, damaged, incorrectly described or incorrectly supplied part.
Aviation safety: The acceptance of a return by JALAERO does not constitute an assessment of airworthiness, approval for installation or certification that a part is suitable for a particular aircraft, engine, propeller or system.

Article 2 – Consumer and business customers

2.1 Consumer customers
A consumer is an individual acting for purposes that do not fall within their commercial, industrial, craft, professional or agricultural activity.
Consumers purchasing eligible products online benefit from the statutory 14-day right of withdrawal described on this page.
2.2 Business customers
Orders placed by airlines, aircraft operators, maintenance organisations, repair stations, workshops, brokers, distributors, aviation professionals, companies or individuals acting for professional purposes are considered business-to-business transactions.
Business customers do not benefit from the statutory consumer right of withdrawal for online purchases, except where mandatory legislation expressly provides otherwise.
Returns requested by business customers are therefore subject to the quotation, purchase order, contractual sales terms and prior written approval issued by JALAERO. A return, cancellation, inspection or restocking charge may apply where this was disclosed and agreed as part of the transaction.
Important: The customer status declared when placing the order must be accurate. Providing a personal name or residential delivery address does not automatically make a purchase a consumer transaction when the part is purchased for professional aviation activities.

Article 3 – Products eligible for withdrawal

3.1 Standard stocked products
Subject to the conditions set out on this page, the statutory right of withdrawal may apply to standard aircraft parts, components, equipment, tools and accessories normally held or offered for sale by JALAERO.
3.2 New and used parts
A part is not automatically excluded from the right of withdrawal merely because it is sold as used, pre-owned, surplus, new old stock, repaired, overhauled, serviceable or in another condition expressly stated in the product description.
To qualify for a full refund, the returned part must remain in the same condition as when delivered and must retain all identification, documentation, packaging and traceability items originally supplied with it.
3.3 Return conditions
An eligible product should be returned with:
- The correct part number or P/N
- The correct serial number or S/N where applicable
- All manufacturer labels and identification plates
- All seals, caps, plugs, protective covers and anti-static packaging
- The original packaging or equivalent protective aviation-grade packaging
- All certificates, tags and traceability documents originally supplied
- Any certificate of conformity originally supplied
- Any EASA Form 1, FAA Form 8130-3 or equivalent release document originally supplied
- All accessories, hardware, manuals and accompanying items included in the order
The references to EASA Form 1, FAA Form 8130-3 and other release documents apply only where such documents were supplied with the product. Not every aircraft part is sold with an authorised release certificate.

Article 4 – Products and orders excluded

4.1 Customised products
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to goods manufactured according to the consumer’s specifications or clearly personalised.
This may include parts that have been specifically manufactured, machined, cut, engraved, programmed, configured, painted, modified or adapted according to technical specifications supplied by the customer.
4.2 Specially configured assemblies
An assembly or kit produced specifically for a customer may be excluded where its components have been permanently modified, combined or configured in a manner that prevents the product from being resold in its standard condition.
4.3 Special-order products
The fact that a standard product was sourced or ordered from a supplier at the customer’s request does not, by itself, automatically remove a consumer’s statutory right of withdrawal.
A special-order product will only be excluded from the statutory consumer right where it genuinely meets one of the legal exceptions, including goods manufactured according to the customer’s specifications or clearly personalised.
For business customers, non-stock products, special procurement orders and products sourced specifically against an accepted quotation may be non-cancellable and non-returnable under the applicable commercial terms.
4.4 Goods irreversibly incorporated into another item
The right of withdrawal may not apply where a product has, by its nature and after delivery, been irreversibly incorporated into or inseparably mixed with another item.
4.5 Statutory rights
No exclusion described in this Article limits the customer’s rights where the product is defective, damaged in transit, incorrectly supplied, counterfeit, not as described or affected by a lack of conformity.

Article 5 – Withdrawal period and notification

5.1 Withdrawal period
The consumer has 14 calendar days to notify JALAERO of the decision to withdraw.
The period begins on the day following receipt of the product by the consumer or by a third party designated by the consumer, other than the carrier.
If a single order is delivered in several separate shipments, the period begins on the day following receipt of the final product.
If the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
5.2 Notification
The consumer must send JALAERO a clear and unambiguous statement expressing the decision to withdraw before the expiry of the 14-day period.
The consumer may use the withdrawal form provided below, but its use is not mandatory.
5.3 Information to provide
To facilitate the identification and processing of the return, the notification should include:
- The customer’s full name
- The order or invoice number
- The delivery date
- The product description
- The part number or P/N
- The serial number or S/N where applicable
- The quantity concerned
- A clear statement confirming the decision to withdraw
The consumer is not required to provide a reason for exercising the statutory right of withdrawal.
5.4 Return Material Authorisation
After receiving the notification, JALAERO may issue a Return Material Authorisation number, also referred to as an RMA number, together with return and packaging instructions.
The RMA number is used to identify and process the returned aircraft part. It does not replace the consumer’s withdrawal notification and does not restrict the exercise of a statutory right submitted within the legal period.

Article 6 – Returning aircraft parts

6.1 Return period
After notifying JALAERO of the decision to withdraw, the consumer must return the product without undue delay and no later than 14 calendar days after sending the notification.
6.2 Technical condition
The product must be returned in the condition in which it was delivered. In particular, the customer must avoid:
- Installing or attempting to install the part on an aircraft, engine, propeller or other system
- Connecting, powering, energising or operating electrical or electronic equipment
- Performing an operational, functional, pressure, hydraulic or bench test beyond what is reasonably necessary to inspect the product
- Disassembling, opening, repairing, modifying, programming or recalibrating the part
- Removing or altering identification plates, labels, security seals or serial numbers
- Removing protective caps, plugs or covers where this is not necessary for a reasonable visual inspection
- Contaminating the product with fuel, oil, hydraulic fluid, chemicals, moisture, dirt or foreign objects
- Writing on, stamping, amending or damaging any certificate, release document, tag or traceability record
6.3 Documentation and traceability
All documents supplied with the product must be returned in their original condition. Missing, altered, separated or damaged documentation may substantially reduce the value of an aircraft part and may prevent it from being returned to inventory with its original status.
Where applicable, the customer must return all original release certificates, conformity documents, trace records, inspection tags, removal tags, manufacturer documentation and records supplied with the product.
6.4 Packaging
The customer must use packaging appropriate to the nature, weight, fragility and sensitivity of the aircraft part.
Electronic and avionics equipment must be protected against electrostatic discharge where required. Openings and fluid ports must remain correctly capped or sealed. Sensitive surfaces, connectors, threads and mounting points must be protected against impact, moisture, contamination and foreign object damage.
6.5 Shipping costs
The direct cost of returning the product is borne by the consumer, unless JALAERO expressly agrees to bear that cost or applicable law requires otherwise.
A tracked and adequately insured shipping service is strongly recommended, particularly for high-value, fragile, serialised or certified aircraft parts.
6.6 Dangerous goods
Where a product contains batteries, chemicals, pressurised elements, fluids, pyrotechnic devices, magnetised materials or any substance subject to transport restrictions, the customer must contact JALAERO before shipment and comply with all applicable dangerous-goods packaging, labelling and transport requirements.

Article 7 – Inspection and refund

7.1 Return inspection
All returned aircraft parts are inspected after receipt. This inspection may include verification of:
- The product identity
- The part number or P/N
- The serial number or S/N
- The quantity returned
- The physical and cosmetic condition
- Evidence of installation, operation, testing or modification
- Evidence of contamination, corrosion, impact or foreign object damage
- The packaging and protective devices
- The presence and integrity of all documentation and traceability records
- The presence of all accessories and components originally supplied
7.2 Diminished value
The consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the product.
For an aircraft part, installation, energisation, operational testing, disassembly, modification, contamination, damage to packaging or the loss or alteration of certification and traceability documents may cause substantial diminished value.
Where diminished value is established, JALAERO may make a proportionate deduction from the refund. The deduction will reflect the actual loss in value and will not constitute an automatic restocking fee.
7.3 Refund period
JALAERO will issue the refund without undue delay and no later than 14 days after being informed of the consumer’s decision to withdraw.
JALAERO may withhold the refund until the returned product has been received or until the consumer provides evidence that it has been dispatched, whichever occurs first.
7.4 Amount refunded
The refund includes:
- The price paid for the eligible returned product
- The cost of the least expensive standard delivery method offered by JALAERO when the entire eligible order is withdrawn
Additional delivery costs resulting from the customer’s choice of an express, priority or more expensive delivery method are not refunded beyond the cost of the standard delivery method.
Return shipping costs are not refunded unless JALAERO has expressly agreed to bear them or the product was returned because it was defective, damaged, incorrectly supplied or not as described.
7.5 Refund method
The refund will be made using the same payment method as the original transaction, unless the consumer expressly agrees to another method that does not result in additional charges.
7.6 Commercial returns
The provisions concerning the statutory consumer refund do not apply to discretionary business-to-business returns. Such returns may be subject to inspection, recertification, testing, freight, administration or restocking charges agreed in the quotation, purchase order or applicable commercial terms.

Compatibility reminder: Before ordering, the customer should verify the exact part number, dash number, modification status, serial-number requirements, aircraft or equipment applicability and the documentation required for the intended installation.
The customer remains responsible for having the part inspected and installed by appropriately qualified and authorised personnel in accordance with the applicable maintenance data, airworthiness requirements and aviation regulations.
These responsibilities do not limit the mandatory statutory rights available to a consumer.
